There exist considerable differences, which go beyond the level of details, not only between Scandinavian law and the other branches of Roman-Germanic law but also betwe'en the different Scandinavian systems themselves. Another frequently used method of characterizing Scandinavian Introduction 33 law, for comparative purposes, in a summary way, is to say that it holds a position intermediate between Continental law and the common-law systems. This is a more questionable way of describing Scandinavian law, for there are in truth very few respects in which the Nordic legal systems present features found in common law but not in the Continental legal systems; there are, it is true, a number of Roman-law institutions which are lacking both in common law and in Scandinavian law, but that common poverty does not tell us much about the relationship between the two legal systems concerned.
The Machinery ofJustice A fuller and more precise description of the Swedish judicial and administrative system will be given in some of the following chapters, Introduction 39 but a very brief sketch already at this place would seem to be of some use to the reader. Until the middle of the 20th century, considerable differences existed between urban and rural courts of first instance. In the 1940s, with the adoption of a new Book on Procedure, most of those differences disappeared, the solution chosen being, essentially, to adopt the rural court system for criminal actions and family law and the urban system for civil actions in general.
A regulation concerning the trade unions' right to strike was also included. Apart from the freedom of the press, which is dealt with in greater detail in a special part of the Constitution, the Freedom of the Press Act (TF), the above-mentioned rights could be restricted by ordinary legislation (in two exceptional cases also by govern men tal decree). But, in another chapter on the lawmaking power, there were regulations which were binding on the legislator and which could not be altered, except by an amendment to the Constitution.
